PERSONAL DATA PROTECTION POLICY PURSUANT TO ARTICLES 13 AND 14 OF REGULATION (EU) no. 679/2016
 
In compliance with Articles 13 and 14 of Regulation (EU) no. 2016/679  (hereinafter referred to as the “Regulation”), the company GIANNI FALCO SRL, as the Data Controller for processing, hereby informs its Customers (hereinafter referred to as the “Data Subjects”), that their personal data (hereinafter referred to as the "Data”) will be processed in a lawful, correct and transparent manner, according to the procedures and for the purposes set out below:
 
1. Source of Personal Data
The Data to be processed are directly acquired by the company GIANNI FALCO SRL and/or by third parties specifically appointed for this purpose, at the premises of Data Subjects and/or third parties, also by remote means of communication used by the company GIANNI FALCO SRL. The Data refer to natural persons (citizens) and are mainly personal details such as e-mail addresses and tax identification codes, also acquired form websites and e-commerce platforms.
 
 2.  Purposes of Processing and Legal Basis
The Data are processed for managing contractual and pre-contractual relations, for managing administrative and accounting matters and for fulfilling related requests.
The Data may be communicated to associated Companies, external Studios, external Professionals, Accountants, the Banking and Financial System, Law Firms for defence in court.
Failure to provide Data or consent to their processing will make it impossible to establish/continue contractual or pre-contractual relations, without this leading to other detrimental consequences.
You may withdraw your consent to processing your Data at any time, without prejudice to the lawfulness of the processing already carried out.
 
 3.  Personal Data Processing Procedures
Your Data will be processed by manual, computer and telematic means, for reasons strictly related to the purposes outlined above and, in any case, in compliance with the precautions, safeguards and necessary measures prescribed by relevant legislation, aimed at ensuring the confidentiality, integrity and availability of your Data and to avoid any damage, whether material or immaterial (e.g. loss of control of Data or limitation of rights, discrimination, theft or misuse of identity, financial loss, damage to reputation, loss of confidentiality of Personal Data protected by professional secrecy or any other significant economic or social damage). Your personal contact Data may also be processed by the dedicated e-commerce platform.
 
4. Special and Sensitive Data
For the purposes specified in point 2, the company GIANNI FALCO SRL will not process your sensitive Data. If it is required for contractual or pre-contractual relations, you will be asked for your explicit consent.
 
 5.  Transfer of Data to non-EU Countries/Organisations
If required, for the purposes referred to in paragraph 3, the Data Subject's Data may be transferred abroad, to EU/non-EU countries/organisations, which ensure a level of Data protection deemed adequate by the European Commission on the basis of its own decision, or as a result of other appropriate safeguards, such as the Standard Contractual Clauses adopted by the European Commission.
A copy of any Data transferred abroad, as well as the list of non-EU countries/organisations to which the Data has been transferred, may be requested from the Data Controller using the contact details specified in paragraphs 8 and 9 below.
 
 6.  Categories of persons to whom Data may be communicated or to those who may become aware of them
To pursue the purposes described in paragraph 3, the company GIANNI FALCO SRL reserves the right to communicate the Data to recipients belonging to the following categories:
• Companies that are affiliated as a result of production / logistics requirements;
• Accountants, Law Firms;
• Supervisory and Control Authorities and Bodies in general, public and private individuals, in prominent positions in public law (in any case, only where the conditions established by applicable legislation are met);
• Professionals, professional Studios or companies involved in contractual or pre-contractual relations;
• The banking, credit and financial system, Persons who are responsible for performing control, audits and certification of the activities carried out by GIANNI FALCO SRL.
Persons belonging to the categories listed above may operate independently as separate Data Controllers or as Data Managers appointed for this purpose by the company GIANNI FALCO SRL, whose constantly updated list is kept at the company GIANNI FALCO SRL.
The Data may also be made known, depending on the assigned tasks performed, by the staff of the company GIANNI FALCO SRL, including trainees, temporary workers and consultants, who are all specifically appointed or responsible for processing.
 
 7.  Retention and Deletion of Personal Data
As provided for in Article 5, paragraph 1, letter e) of the Regulation, the Data will be kept in a form that allows the identification of the data subject for a period of time not exceeding that required to achieve the purposes for which they were processed. After this period, the Data will be deleted, unless their subsequent retention is required to fulfil legal obligations or comply with orders from Public Authorities and/or Supervisory Bodies.
 
 8.  Rights of Data Subjects
In compliance with Articles 15 to 22, the Regulation allows Data Subjects to exercise specific rights.
In particular, the Data Subject may obtain: a) confirmation of the existence of the processing of his/her personal data and, in this case, access to such data; b) the rectification of any inaccurate personal data and the integration of incomplete personal data; c) the deletion of his/her personal data in cases where this is permitted by the Regulation; d) the restriction of processing, in cases provided for by the Regulation; e) communication to recipients to whom personal data have been transmitted, of requests for rectification/deletion of personal data and the restriction of processing by the Data Subject, unless this proves impossible or involves a disproportionate effort; f) the receipt, in a structured format commonly used and readable by an automatic device, of personal data provided by the Data Controller, as well as the transmission of such data to another data controller, and at any time, also upon termination of any existing relations with the Data Controller.
The Data Subject also has the right to object, at any time, to the processing of his/her personal data: in such cases, the Data Controller is required to refrain from any further processing, without prejudice to cases permitted by the Regulation.
The Data Subject also has the right not to be subject to a decision based solely on automated processing, including profiling, which has legal consequences that concern him/her or which significantly affects him/her in a similar manner, unless such a decision: a) is required for the conclusion or execution of a contract between the Data Subject and the Data Controller; b) is authorised by EU legislation or by a Member State to which the Data Controller belongs; c) is based on the explicit consent of the Data Subject. In the cases referred to in the afore-mentioned letters a) and c), the Data Subject has the right to obtain the human intervention of the Data Controller to express his/her point of view and contest the decision.
Requests may be submitted to the organisational unit responsible for responding to the Data Subject, by ordinary mail sent to the Data Controller's registered office or by e-mail sent to the following address: info@giannifalco.com   

The Data Subject also has the right to lodge a complaint with the Data Protection Authority.
